1. Acceptance of Terms

By accessing or using the website smartsteplending.com (the "Site") or any services provided by Smart Step Lending LLC ("Smart Step Lending," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the Site or our services.

2. Description of Services

Smart Step Lending LLC operates as a marketing, education, lead-intake, and communications business. We provide general information about mortgage loan products, an online mortgage application referral, an FSBO ("For Sale By Owner") support program, and related content. Smart Step Lending LLC is not a mortgage lender or broker.

Mortgage loan origination services referenced on this Site are provided by Adam Koncurat, individually licensed as a Mortgage Loan Originator, NMLS #2727504, operating through NEXA Mortgage, LLC, NMLS #1660690, an Equal Housing Lender. Use of the Site does not create a loan application, pre-approval, pre-qualification, or lender-client relationship. No mortgage loan origination fee is charged by Smart Step Lending LLC.

3. Eligibility and User Responsibilities

You must be at least 18 years old to use this Site. You agree to provide accurate, current, and complete information when submitting any form on the Site, and to use the Site only for lawful purposes. You agree not to misrepresent your identity, submit information on behalf of another person without authorization, or attempt to interfere with the proper functioning of the Site.

4. No Guarantee of Loan Approval or Rates

Nothing on this Site constitutes a commitment to lend, a rate lock, or a guarantee of loan approval. Any rates, payment estimates, or program information displayed (including any calculator results) are for illustrative purposes only, are not personalized quotes, and are subject to change without notice. All loan applications are subject to credit approval, underwriting review, and property evaluation.

5. FSBO Pro Program

FSBO Pro is a program Adam Koncurat participates in as a member with FSBO.com, an independent third-party company. It does not involve a real estate listing agreement, real estate brokerage services, or a real estate commission. Smart Step Lending LLC does not own or operate FSBO.com and makes no warranty regarding FSBO.com's products or services.

6. Third-Party Links and Services

This Site may link to or integrate with third-party websites and services (for example, scheduling tools, application portals, or FSBO.com). We do not control and are not responsible for the content, privacy practices, or terms of any third-party site. Your use of third-party services is governed by their own terms and privacy policies.

7. Intellectual Property

All text, graphics, logos, and other content on this Site, excluding third-party content, are the property of Smart Step Lending LLC or its licensors and may not be copied, reproduced, or distributed without prior written permission.

SMS Messaging Terms

By providing your mobile phone number and opting in, you consent to receive text messages from Smart Step Lending LLC and Adam Koncurat as described below. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP. For assistance, reply HELP.

Informational SMS

We may send you customer-care and informational text messages regarding your inquiry, appointments, document requests, mortgage application, loan status, transaction status, and services you requested. Consent to receive informational messages is not a condition of purchasing goods or services.

Marketing SMS

With your separate consent, we may send recurring marketing and promotional text messages regarding mortgage and real estate services, educational information, program announcements, rate-related information, and promotional offers. Consent to receive marketing messages is not a condition of purchasing goods or services.

Opt-Out and Help

You can opt out of receiving text messages at any time by replying STOP to any message. For help, reply HELP. Standard message and data rates may apply.

Data and Privacy

Your phone number and consent preferences are handled in accordance with our Privacy Policy. We do not sell your information.

These SMS Messaging Terms are part of our overall Terms and Conditions. By consenting to SMS communications, you agree to these terms.

AI Voice Assistant Disclosure

Calls to our published business phone numbers may be answered, in whole or in part, by an AI-powered virtual assistant ("Sona") rather than by a natural person. If you ask whether you are speaking with a person or an automated assistant, Sona will disclose this to you honestly.

Call Recording

Calls handled by Sona may be recorded and/or transcribed for quality assurance, customer service, follow-up, and business recordkeeping purposes. Continuing a call after this notice constitutes your acknowledgment of this practice to the extent permitted by applicable law.

Scope and Limits of the AI Assistant

Sona is not authorized to, and will not, quote interest rates, APRs, fees, payments, closing costs, or loan terms; state or imply that any caller is approved, pre-approved, qualified, denied, or eligible for any loan; or provide legal, tax, credit, or financial advice. Sona will not request Social Security numbers, dates of birth, bank account or credit card numbers, tax documents, income documentation, or other sensitive financial information over the phone. All mortgage-specific guidance is provided directly by Adam Koncurat after reviewing your full situation, and you may request to speak with him directly at any time.

Data Handling

Information collected by Sona (such as your name, phone number, email address if offered, and general reason for calling) is handled in accordance with our Privacy Policy.

This AI Voice Assistant Disclosure is part of our overall Terms and Conditions.

8. Limitation of Liability

To the fullest extent permitted by law, Smart Step Lending LLC, Adam Koncurat, and NEXA Mortgage, LLC are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Site or our services, even if advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless Smart Step Lending LLC, Adam Koncurat, and NEXA Mortgage, LLC from any claims, losses, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

10. Dispute Resolution

If a dispute arises out of or relates to these Terms or your use of the Site, we encourage you to first contact us using the information in Section 13 so we can attempt to resolve it informally. Nothing in this section limits either party's right to seek relief in a court of competent jurisdiction in Colorado.

11. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted to this page with a revised effective date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles.

14. General Provisions

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smart Step Lending LLC regarding the Site. We may assign these Terms in connection with a merger, acquisition, or sale of assets. Our failure to enforce any right or provision is not a waiver of that right or provision.
